General conditions of sale and use

ARTICLE 1: Application and Acceptance of the General Terms and Conditions of Sale

These general terms and conditions of sale ("GTC") apply, without restriction or reservation, to all contracts concluded between SRL Yval, operating under the trade name "Grands Crus," registered with the Banque Carrefour des Entreprises under the number BE0841.531.715, with its registered office located at Place Stéphanie 12, 1050 Brussels, hereinafter referred to as "Grands Crus," and any consumer or professional buyer (the "Client" or "You") wishing to acquire the products and/or services offered for sale (the "Products") by Grands Crus, whether online or face-to-face. They specify, in particular, the conditions of ordering, payment, delivery, and any potential complaints. The GTC are accessible at any time on the Website or upon request at the email address info@grandscrus.eu. The GTC may be subject to subsequent modifications; the version applicable on the day of the Client's order confirmation is the one in force on the Website at the date of the order. They shall prevail over any other version or contradictory document. Grands Crus therefore invites Clients to carefully review the current GTC with each new order. Any validation of an order by the Client constitutes full and complete acceptance of these GTC and the specific conditions of their order (products, quantities, prices, delivery methods, and deadlines, etc.). The Client declares to have read and accepted them before validating the order.

ARTICLE 2: Products

2.1 Product Information Grands Crus takes particular care in the presentation of each Product on the Website, indicating their sales designation, the quantities ordered, their price, the payment methods accepted by Grands Crus, any delivery restrictions, and the mandatory information required by current legislation, thereby allowing the Client to know their essential characteristics. The photographs of the Products are non-contractual and are provided for illustrative purposes only. Any error considered as material will not entail any liability on the part of Grands Crus. Availability of ProductsGrands Crus reserves the right to modify its offer and its range of Products at any time. Grands Crus undertakes to fulfill orders received on the Website only within the limits of available stock. Exceptionally, a Product announced as available on the Website may become unavailable after the final registration of the order. In case of unavailability of the Product, Grands Crus will inform the Client by email that their order has been canceled and will refund the Client within thirty (30) working days, unless the Client expressly wishes to transfer their order to a substitute Product recommended or not by Grands Crus.

ARTICLE 3: Order and Preorder

3.1 Account Creation To place an order, the Client must have opened an account on the Website, which requires the provision of personal data. For more information on the use of personal data, the Client can refer to our Privacy Policy (which forms an integral part of these general terms) at the following address: https://www.grandscrus.eu/terms-conditions. The Client confirms that the information provided to Grands Crus is sincere, accurate, and up-to-date. The Client can update and correct their data at any time by visiting their customer account. All information provided by the Client remains their sole responsibility, and any anomalies generated by the Client cannot be attributed to Grands Crus if it becomes impossible to place the order or to ensure a positive outcome. The Client must choose a login and password to access their account, which they must not disclose to anyone. Grands Crus will not be responsible for any loss or damage that may occur as a result of a lack of protection of the login or password. If the Client has forgotten their password, an appropriate function on the Website allows the Client to retrieve it using their email address.

3.2 Registration of Order or Preorder The registration of an order or preorder is carried out according to the following modalities (which may occur in a different order than presented below without affecting the validity of the order):

  • Selection of Products by adding to the cart;

  • Selection of the delivery method;

  • Validation of the cart contents;

  • Identification of the Client with the creation or connection to their customer account;

  • Information on delivery (method, costs, and delivery times);

  • Information on billing;

  • Confirmation of delivery terms;

  • Verification and validation of the order;

  • Acceptance of the GTC and the privacy statement by checking the appropriate box;

  • Information and validation of payment. The Client has the opportunity to correct or modify their choices at each stage of the order entry process and before validation. The information provided by the Client when placing the order is binding: in case of error by the Client in the labeling of their details or those of the recipient or the place of delivery, notably their name, first name, address, phone number, email address, door code, floor, resulting in the loss of the Products, the Client will be responsible for paying for the lost Products, and no compensation or refund can occur. Before validating the payment of their order, the Client must check the accuracy of the order and make the necessary modifications. The Client's validation of the order implies acceptance of the entire GTC and privacy policy. Once validated by the Client, the order is automatically registered. No modifications will be taken into account by Grands Crus.

3.3 Order or Preorder Confirmation Grands Crus confirms the receipt of the order or preorder to the Client by email at the address provided by the Client to recap (i) the Products ordered (or preordered), (ii) the address, (iii) the date and mode of delivery, (iv) the payment method, and (v) their order number. Any order placed via the Website by the Client will only be final after the Client has received the order (or preorder) confirmation and after the bank has recorded the full price of the order (or preorder), including delivery charges. The sales contract between the Client and Grands Crus is formed at the time of the order or preorder confirmation by Grands Crus.

Grands Crus reserves the right to cancel or refuse any order from a Client with whom there is a dispute concerning the payment of a previous order or who presents any risk in Grands Crus' view.

3.4 Modification of Order or Preorder Any modification of the order or preorder by the Client after confirmation of their order or preorder by Grands Crus is subject to the prior acceptance of Grands Crus. Proof of Order The confirmation of the order or preorder by Grands Crus, the data recorded by Grands Crus through the automatic recording systems of the Website or its remote sales service, as well as any email exchanged between Grands Crus and the Client, will be considered as proof of the nature, content, and date of the transaction in the event of a dispute between the parties and will be kept by Grands Crus for the necessary duration in accordance with legal prescription rules.

ARTICLE 4: Price and Payment Methods

4.1 Price The Products are provided at the prices in effect listed on the Website at the time of order or preorder registration by the Client. Prices are expressed in euros, including all taxes in effect in Belgium on the day of order registration, and excluding shipping costs. Handling, shipping, transport, and delivery costs will be charged additionally under the conditions indicated on the Website and calculated before order validation. Any additional charges added to the price of the Products ordered or preordered must be expressly consented to by the Client. The total price including VAT indicated in the order confirmation sent by Grands Crus is the total order price, including all taxes, the price of the Products, and additional charges, including transportation costs. Prices displayed on the Website may be revised at any time without notice, depending on the seasonal product prices and economic conditions.

4.2 Payment (Transaction Security) The Client acknowledges that placing an order or preorder necessarily entails payment in full at the time of the order or preorder by the payment methods offered and exclusively through a secure payment system.

Bank Transfer The Client must transfer the total amount mentioned during the order process to the seller's account within 10 days, with reference to the order or preorder number. Note: When the Client pays by bank transfer, their package will only be sent after payment is received. This may take a few days.

PayPal, Stripe, Mollie, Vivawallet Payment for orders placed on the website can also be made via the secure payment platforms PayPal, Stripe, Mollie, Viva Wallet. Several electronic payment methods by credit card are offered. Transactions carried out on the site are secured by these platforms' payment systems. All information exchanged to process the payment is encrypted using the SSL protocol. This data cannot be detected, intercepted, or used by third parties. It is also not stored on our computer systems. Thus, Grands Crus never has, at any time during the purchase process, knowledge of the Client's banking information. 4.3 VAT Exemption All products shipped outside the European Union can be exempted from VAT; the amount of the exemption will be automatically deducted from the invoice, provided that all conditions and/or formalities related to the possible VAT exemption are met. In the case of shipment to a country outside the European Union, customs duties or other local taxes, import duties, or state taxes may be payable upon receipt. These fees and amounts are your responsibility and fall entirely under your responsibility in terms of declarations and payments to the authorities and competent bodies of your country.

ARTICLE 5 . Delivery

5.1 Conditions

Shipment of the Products can only occur after payment has been validated. The ordered or pre-ordered Products will be delivered in Belgium as well as in certain European countries. Delivery takes place according to the timeframes indicated for each delivery method based on the carrier's instructions and to the address provided by the Customer when placing their order on the Website. Delivery is constituted by handing over the parcel to the buyer.

Unless in exceptional cases or unavailability, the ordered or pre-ordered Products are delivered in a single shipment.

The Customer is responsible for the information regarding the recipient's name and address. These details must be precise, accurate, and complete (including door code and floor) to ensure delivery under normal conditions. Grands Crus can under no circumstances be held responsible for a return due to an address error or the inability to deliver to the specified address.

For all deliveries and shipments, we ask our customers to ensure the presence of their recipients on the day of delivery.

If the recipient is absent, the carrier will leave a delivery notice at the delivery location with instructions on how to retrieve the parcel.

5.2 Delivery Time

Grands Crus makes its best efforts to deliver the Products ordered or pre-ordered by the Customer as quickly as possible. When Grands Crus operates with pre-orders, the delivery of these also depends on the suppliers’/producers’ delivery times, which may vary. Grands Crus is responsible for the proper execution of the contract under the conditions of Article VI.103 of the Code of Economic Law.

If the ordered or pre-ordered Products are not delivered within thirty (30) working days after the order confirmation, for any reason other than force majeure or the Client's act, the sale may be terminated at the Client's request under the conditions provided in Article VI.43 of the Code of Economic Law. The amounts paid by the Client will be refunded no later than fourteen (14) days following the date of contract termination, excluding any compensation or deductions.

5.3 Delivery Methods

The Customer may choose:

  • Either to collect their order themselves at one of Grands Crus' stores/depots in Belgium. If they choose this option during the order or pre-order process, they will proactively contact Grands Crus or Grands Crus will contact them to schedule an appointment to pick up the items. This appointment will be scheduled as soon as possible after payment acceptance.

    Any order not collected on the scheduled dates and times will be lost and chargeable, if applicable.

  • Or to have their order or pre-order delivered by a carrier according to the rates and timeframes announced by the different carriers that Grands Crus may use.

5.4 Delivery Tracking

Once the order or pre-order is placed, the Customer will receive an email for:

  • Confirmation of your order or pre-order including shipping fees,

  • Validation of your payment method,

5.5 Delivery Timeframe

Depending on the carrier used in Belgium and the shipping timeframe of the order (or pre-order) by the producer, delivery times may vary. The timeframes announced by Grands Crus are therefore always given strictly for informational purposes.

5.6 Delivery Delay

Grands Crus does its best to ensure parcels arrive as quickly as possible to the Customer. It is possible that, exceptionally, a delay in delivery occurs relative to the announced timeframes. Tracking the parcel is possible to know where the parcel is and what the delivery status is. The Customer must inform Grands Crus of any delay so that Grands Crus can quickly ensure the parcel is not lost. In no case can a delivery delay justify any claim (price reduction or refund) against Grands Crus.

5.7 Product Reference Errors

The Client is required to check the contents of the package upon receipt. If product or quantity errors have unfortunately occurred, the Client must inform Grands Crus within 24 hours of receiving the package.
Grands Crus will then assess the validity of the claim and propose a solution to the Client, as described below. In case of a missing product, the Client will have the choice between a refund for the concerned product or its free delivery. In the event of a reference error, Grands Crus will exchange the product, with the costs of this procedure being borne by Grands Crus. No other compensation will be considered.

ARTICLE 6: Reception

Reception of the Products occurs when the Client takes physical possession of the Products ("Reception"). The Client must check the condition of the Products upon Reception and inform Grands Crus of any apparent defects within 24 hours of reception.

ARTICLE 7: Transfer of Risk

Reception of the Products occurs when the Client takes physical possession of the Products ("Reception").
The transfer of risk will occur upon Reception of the Products. From this date, the Client will assume full responsibility for any damage the Products may suffer or cause.

ARTICLE 8: Claims and Customer Service

Grands Crus makes every effort to satisfy its customers. However, the Client may address complaints to Customer Service:

  • Online, by filling out the contact form on the Website.

Grands Crus is not responsible for indirect, incidental, punitive, or consequential damages including, without limitation, loss of profits, revenue, or benefits arising from or related to a breach of these general terms and conditions of sale or a claim against you by any third party.

ARTICLE 9: Right of Withdrawal

The right of withdrawal does not apply to counter sales or contracts for the supply of the following Products:

  • Goods made to the consumer's specifications or clearly personalized: this concerns all customized orders such as tiered cakes, macaroon boxes, etc.

  • Goods unsealed by the Client after delivery and which cannot be returned for reasons of hygiene or health protection, such as opened food products.

As Grands Crus mainly sells gastronomic products, the right of withdrawal generally does not apply to ordered or pre-ordered products.

For any other Products and sales, in accordance with the regulations in force, the Client has a period of fourteen (14) days from the receipt of the Product to exercise their right of withdrawal with the Seller, without having to justify reasons or pay penalties, for the purpose of exchange or refund.

The right of withdrawal can be exercised on free paper stating the Client's clear intention to exercise their right of withdrawal or via the completed and signed standard form (see below). An acknowledgment of receipt will be immediately communicated to the Client by Grands Crus. A copy of this acknowledgment must be included in the return package.

Products must be returned within fourteen (14) days of the Seller's notification of the Client's decision to withdraw, accompanied by the purchase invoice in their original packaging and in perfect condition allowing their resale as new. Damaged, soiled, or incomplete Products will not be accepted.

In case of exercising the right of withdrawal within the above-mentioned period, only the price of the purchased Products and delivery costs will be refunded; return costs remain the responsibility of the Client. The risk, quality, and tracking of this return are the responsibility of the Client.
Exchange (subject to availability) or refund will be made within fourteen (14) days from the receipt by Grands Crus of the Products returned by the Client under the conditions of this article.

Grands Crus reserves the right to refuse a return if it does not meet the conditions stated above.

Discounted products (promotions, fan actions, ...) will not be taken back or exchanged.

ARTICLE 10: Guarantees

The Products sold on the Website comply with the regulations in force in Belgium. The Products benefit by right and in accordance with legal provisions from the legal guarantee of conformity and the legal guarantee against hidden defects provided they are exercised within one month of receiving the item and normal use has been made.

ARTICLE 11: Intellectual Property Rights

The content of the Website including, but not limited to, trademarks, patents, texts, comments, illustrations, photographs, and images reproduced on the Website are the exclusive property of Grands Crus and are protected by intellectual property rights. Any total or partial reproduction of the Website is strictly prohibited unless prior written authorization is obtained from Grands Crus. Any violation of our trademarks and the integrity of our Products could justify civil or criminal proceedings. Any unauthorized use will be at the sole responsibility of the third party.

ARTICLE 12: Applicable Law and Disputes

These GTC as well as the relations between Grands Crus and its customers are subject to Belgian law.

In the event of a dispute, an amicable solution will be sought as a priority before any legal action. For this purpose, we ask our Clients to kindly contact our Customer Service by mail at the following address: Place Stéphanie 12, 1050 Brussels. Failing an amicable solution, any legal action will be brought before the courts of the French-speaking judicial district of Brussels. The procedure will take place in French.
